Purpose and Scope
This artificial intelligence agent (hereinafter, "FRACTTAL AI") is a tool specialized in the analysis of work orders, meters, and assets, designed to assist in the interpretation of technical and operational data. Its use is subject to the terms and conditions established by Fracttal, and its functionality does not replace human judgment or professional supervision.
Data Use and Algorithm Training
All information processed by FRACTTAL AI, including data entered by the user and generated results, may be used for the training, improvement, and optimization of artificial intelligence algorithms. The user agrees that Fracttal may use such data in an anonymized and aggregated form, in accordance with applicable regulations.
Fracttal does not guarantee the absolute accuracy of the analyses generated by FRACTTAL AI. The user is responsible for verifying the information before making decisions based on it. FRACTTAL AI may make errors, and its results should be considered as a reference guide, not as definitive advice.
The use of FRACTTAL AI implies the express acceptance of:
Fracttal's Terms and Conditions of Service
The associated Privacy Policy and Legal Notice.
The non-exclusive assignment of rights over the data entered for the purpose of system improvement.
Disclaimer
Fracttal shall not be liable for direct, indirect, or consequential damages arising from the use or inability to use FRACTTAL AI, including but not limited to economic losses, operational interruptions, or technical decisions based on its results.
Fracttal S.L., in compliance with applicable Spanish legislation, expressly exempts itself from liability for damages of any kind (direct, indirect, consequential, or loss of profit) arising from the use, misuse, or inability to use FRACTTAL AI; technical, operational, or commercial decisions based on analyses generated by the AI; errors, omissions, or inaccuracies in the results provided by the system; operational interruptions, including but not limited to technical failures not attributable to Fracttal; and data loss not caused by willful misconduct or gross negligence of the company.
This limitation does not affect the rights recognized to the user under the GDPR. It does not apply in cases of willful misconduct, gross negligence, or breach of essential obligations under the Spanish Civil Code.
The user acknowledges that FRACTTAL AI is a support tool and that Fracttal does not guarantee its infallibility. The ultimate responsibility for decisions lies with the user.
The Data will not be used by Fracttal for purposes other than the Services for the benefit of the user, understanding that Fracttal neither assumes nor will assume any obligation or responsibility regarding the Data or the use the user makes of them, who as the owner of such Data is and will always be responsible for their use and content, assuring the user that at all times the Data will not be used for unlawful purposes or contrary to applicable legislation, or in any way that infringes the rights of any third party.
Fracttal does not guarantee the accuracy, completeness, or suitability of the results provided by FRACTTAL AI, which should be considered as technical support recommendations and not as definitive advice. The user acknowledges that they are solely responsible for decisions made based on these results, releasing Fracttal from any claims for direct, indirect, or consequential damages arising from their use, including but not limited to economic losses, operational interruptions, or technical errors, except in cases of willful misconduct or gross negligence duly demonstrated in accordance with Spanish law.
The user expressly authorizes Fracttal, through the use of FRACTTAL AI and the access and entry of information, to use anonymized data derived from their interaction with FRACTTAL AI (including operational metrics, usage patterns, and generated results) for the training, development, and continuous improvement of artificial intelligence algorithms, in compliance with the GDPR and the Data Act.
This authorization is understood as a non-exclusive, irrevocable, and royalty-free license, without the right to economic compensation, guaranteeing that Fracttal applies technical and organizational measures to preserve the privacy and security of the data in accordance with the data processing policy.
Regulatory Compliance and Acceptance of Terms
The use of FRACTTAL AI implies the express acceptance of these Terms and Conditions, as well as Fracttal's Privacy Policy.
The user agrees to use the service in accordance with applicable law, including the LOPDGDD, and acknowledges that Fracttal may suspend or limit access in case of fraudulent use, violation of third-party rights, or breach of these conditions. Any dispute will be resolved under the jurisdiction of the courts of Madrid, with express waiver of any other jurisdiction.
